29 June 2009 -- AEP business unit Southwest Electric Power Co. plans to appeal a court ruling that revoked its permit to build the $1.6 billion, 600 MW John W. Turk Jr. coal-fired power plant in southwest Arkansas.
Southwest Electric Power Co. says it will appeal a ruling that revoked its permit to build a $1.6 billion coal-fired electric generation plant in southwest Arkansas.
On June 24, the Arkansas Court of Appeals ruled that state utility regulators had not followed proper procedures in holding hearings on the proposed plan. The court was also critical of how the site was selected.
The ruling said SWEPCOwould have to file a new application for the plant with regulators if it still wanted to build the plant.
The utility can appeal the ruling to the Arkansas Supreme Court.
