29 February 2008 - A German court has barred RWE, the country's largest power producer, from extending the operating life of one of its nuclear power plants in the town of Biblis, dealing a blow to hopes of a nuclear revival.
The administrative court in Kassel ruled that RWE may not run its Biblis A nuclear power plant for a longer period in return for having shut down another nuclear power station in Muehlheim-Kaerlich.
German legislation regarding nuclear power stations does not allow this, the court said. RWE said on Wednesday it plans to appeal the verdict at the Federal Administrative Court.
The court upheld a decision from the Environment Ministry that had barred RWE from transferring unused generation capacity from one power plant to another.
The latest ruling reduces hopes RWE will be able to keep the Biblis A plant open until after the next general election in 2009, when an outright win of the Christian Democrats would raise the possibility of a change in the national nuclear phase-out agreement.
