15 September 2006 -- The Dallas Business Journal reports that Glenn Shankle, head of the state's chief environmental agency, said TXU should win an air quality permit to build its Oak Grove coal-fired power plant, despite a recommendation last month by administrative law judges to deny the permit. Approval of the permit would allow TXU to build the plant. In his filing, TCEQ's Shankle reportedly says TXU's draft permit "contains adequate provisions to ensure compliance with applicable statutory and regulatory requirements necessary for permit issuance."
Shankle also requests that wording in the administrative law judges' conclusions be changed from stating that TXU "failed to prove by a preponderance of the evidence" to "has presented evidence in support of representation." TXU hopes to win its permit by year's end.
The plant is part of a $10 billion plan TXU announced in April to build 11 new generation power plants at nine existing TXU power sites.
