9 August 2006 -- An effort by the state of Nevada to stall the Yucca Mountain Repository project was denied by the U.S Court of Appeals for the District of Columbia Circuit yesterday. Nevada argued that the U.S. Department of Energy's plan to transport nuclear waste by rail to Yucca Mountain was "procedurally flawed" and violated the National Environmental Policy Act (NEPA).
The court ruled that the DOE's analysis of using the Caliente Corridor to transport spent nuclear fuel by railroad was adequate as outlined in the DOE's Final Environmental Impact Statement (FEIS).
In mid-July, the DOE announced plans to move forward on the licensing of the Yucca Mountain project with the Nuclear Regulatory Commission (NRC) within one year. The Department also announced that if requested legislative changes are enacted, the repository will be able to accept spent nuclear fuel and high-level waste starting in early 2017.
