Power Engineering - Mark Crosswhite named Southern Co. generation and energy marketing senior vice president, general counsel

ATLANTA, March 19, 2004 -- Mark Crosswhite has been named vice president and associate general counsel for Southern Company Services.

He also will serve as senior vice president and general counsel for Southern Company Generation and Energy Marketing, a business unit of Southern Company that works to manage and generate electricity for the company's retail customers and markets energy in the competitive wholesale supply business.

In addition, he will serve as general counsel for Southern Power, the Southern Company subsidiary that builds, owns and manages the company's competitive generation assets.

In his new role, Crosswhite will direct legal services and external affairs efforts for Southern Company Generation and Energy Marketing and Southern Power. He will oversee regulatory, federal and state interactions as well as internal and external communication. Crosswhite will work closely with Southern Company's external affairs, governmental relations and corporate communication groups. He also will manage Southern Company's legal services group.

"Mark has 17 years of experience in working closely with Southern Company on complex legal issues. He has a breadth of experience with FERC issues, state public service commission issues and other electric utility industry issues across the Southeast."

Crosswhite previously served as a partner with Balch & Bingham in the law firm's Birmingham, Ala., office, practicing in the utility, legislative and regulatory section. He has represented Southern Company in numerous regulatory proceedings involving rates, power sales agreements, transmission, interconnection and industry structure. He also has represented Southern Company in a variety of transactions and contract negotiations with utilities and customers.

Crosswhite earned his bachelor's degree from the University of Alabama at Huntsville in 1984, where he graduated magna cum laude. He earned his law degree from the University of Alabama School of Law in 1987, where he was a member of Order of the Coif, senior editor of Alabama Law Review and a Hugo Black Scholar. He currently serves as vice chair of the Public Utility, Communications, Aviation and Transportation Section of the American Bar Association. He also is a member of the Birmingham Bar Association, Alabama Bar Association and Energy Bar Association.
