24 June 2009 -- An Arkansas appeals court ruled that state regulators didn't adequately review plans for the $1.6 billion, 600 MW coal-fired John W. Turk Jr. power plant being built by SWEPCO. The court rejected a permit allowing its construction.
If Southwestern Electric Power Co. wants to reapply for a permit, Arkansas regulators must hold new hearings on whether the plant is necessary and meets other regulatory requirements, the court said.
Preliminary construction has been going on for months at the plant site. Shaw Group holds an EPC contract and Babcock & Wilcox has an order for the plant's boiler.
A separate decision that's pending for the plant is from the Arkansas Department of Environmental Quality on an appeal of its grant of an air-quality permit.
SWEPCO is a unit of American Electric Power.
